THIS IS A RELEASE OF LIABILITY & WAIVER OF CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION
1. Activities Covered
Each person participating in volunteer activities with Food for Thought Denver, a Colorado nonprofit corporation (“Nonprofit”), is referred to as a “Participant.” I, the undersigned, am a Participant and, if the Participant is a minor, I am the Participant’s parent or legal guardian.
Volunteer activities include, without limitation: filling, packing, lifting, carrying, loading, unloading, and transporting boxes of food and supplies; using carts, dollies, and pallet jacks; assisting with delivery operations including meeting trucks at schools and unloading food; and related tasks performed indoors or outdoors at warehouses, schools, or other sites (collectively, the “Activity”). I understand that participating in the Activity involves physical exertion and may expose Participant to the risk of injury.
2. Assumption of Risks
I understand that participation in the Activity involves certain risks and dangers, including but not limited to:
- Heavy lifting and repetitive movements leading to strains, sprains, or other musculoskeletal injuries;
- Use of dollies, pallet jacks, and other equipment;
- Slips, trips, falls, or falling objects;
- Risks associated with unloading food from trucks, including working around vehicles and handling heavy pallets or boxes;
- Cuts, bruises, allergic reactions, exposure to dust or food products, or other health conditions arising from contact with food or packaging materials;
- Exposure to illness, including COVID-19 and other communicable diseases;
- Negligence or carelessness by Participant, other volunteers, staff, or third parties.
- Damage to or loss of personal property.
I VOLUNTARILY ASSUME ALL RISKS, known and unknown, inherent and otherwise, associated with the Activity, and accept full responsibility for any injury, illness, death, property damage, or other loss arising from my participation.
3. Release of Liability
In consideration for being allowed to participate in the Activity, I, to the fullest extent permitted by Colorado law, hereby release, waive, discharge, and covenant not to sue the Nonprofit, its directors, officers, employees, agents, affiliates, volunteers, sponsors, successors, and assigns (each a “Released Party”) from any and all claims, liabilities, demands, or causes of action for injury, illness, death, property damage, or loss that I may suffer, arising in whole or in part from my participation in the Activity, including but not limited to claims based on the alleged or actual negligence of any Released Party.
This release does not extend to claims based on a Released Party’s gross negligence or willful or wanton misconduct.
4. Indemnity
I agree to defend, indemnify, and hold harmless each Released Party from and against any and all claims, demands, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from or related to my participation in the Activity.
5. Personal Property
I understand that the Nonprofit is not responsible for any loss of, theft of, or damage to my personal property while participating in the Activity.
6. Representation and Authority
I understand and agree that I am a volunteer and not authorized to speak on behalf of, represent, or enter into any agreements on behalf of the Nonprofit without the prior written consent of the Nonprofit’s authorized officer.
7. Condition of Participation
- By registering to volunteer, whether online or in person, I acknowledge and agree to the terms of this waiver.
- A copy of this waiver, including a hard copy, will be provided upon request.
- If I do not agree to or sign this waiver, I understand that I cannot participate as a volunteer.
8. Minors
If I bring a minor to volunteer:
- I represent that I am the minor’s parent or legal guardian.
- I acknowledge and accept the risks of the Activity on the minor’s behalf, authorize their participation, and consent to emergency medical care if needed.
- I understand that, under Colorado law, I cannot waive a minor’s own claims for personal injury.
9. Medical Authorization
I represent that I am in good health and physically able to participate in the Activity. I authorize emergency medical care if deemed necessary and agree to be responsible for associated costs.
10. Media Release
I grant the Nonprofit permission to use my name, image, and likeness in photographs, video, or other media taken during the Activity for Nonprofit’s promotional, educational, or fundraising purposes, without compensation.
11. Governing Law & Severability
This Agreement shall be governed by the laws of the State of Colorado. Exclusive jurisdiction shall be in a court of competent jurisdiction in Denver, Colorado. If any provision is held unenforceable, the remainder shall remain in full force and effect.
12. Acknowledgment
I understand that this is a binding legal contract. I have read it carefully, had the opportunity to ask questions, and understand that by completing the registration and providing my inititals I voluntarily agree to it with the intent to release legal rights.
